To Consider Adoption of an Ordinance Establishing the
SweetBay Residential Community Development Districts 1-7 and SweetBay Non-Residential Districts 1-2 DATE: May 9, 2023

In compliance with the provisions of Chapter 190, Florida Statutes, a public hearing will be held by the City Commission of Panama City, Florida to consider an ordinance to grant a petition to establish the SweetBay Residential Community Development Districts 1-7 and the SweetBay Non-Residential Community Development Districts 1-2 (“Districts”), which is titled:
AN ORDINANCE OF THE BOARD OF CITY COMMISSIONERS OF PANAMA CITY, FLORIDA, ESTABLISHING THE SWEETBAY RESIDENTIAL COMMUNITY DEVELOPMENT DISTRICTS 1-7 and the SWEETBAY NON-RESIDENTIAL COMMUNITY DEVELOPMENT DISTRICTS 1-2 PURSUANT TO CHAPTER 190, FLORIDA STATUTES; PROVIDING A TITLE; PROVIDING FINDINGS; CREATING AND NAMING THE DISTRICT; DESCRIBING THE EXTERNAL BOUNDARIES OF THE DISTRICT; DESCRIBING THE FUNCTIONS AND POWERS OF THE DISTRICT; DESIGNATING FIVE PERSONS TO SERVE AS THE INITIAL MEMBERS OF THE DISTRICT’S BOARD OF SUPERVISORS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS OF LAW; PROVIDING FOR CODIFICATION, INCLUSION IN CODE, AND SCRIVENER’S ERRORS; AND PROVIDING FOR AN EFFECTIVE DATE.
The proposed Districts are comprised of approximately 550 acres, generally located northwest of St. Andrews Boulevard (SR 390) at Frankford Avenue and is depicted in the adjacent map. The petitioner has proposed to establish the District to plan, finance, acquire, construct, operate and maintain infrastructure and community facilities which may be authorized by such District under Florida law, including but not limited to: roads, stormwater facilities, utilities, and parks, and other infrastructure.
A previous public notice stated the public meeting was to be held on April 18, 2023. The public meeting which was previously noticed for that date has been rescheduled for May 9, 2023.
Copies of the petition and the proposed ordinance are open to public inspection on weekdays between the hours of 8:00 a.m. and 5:00 p.m. at the City Clerk’s Office, 1st Floor, City Hall, Panama City, Florida.
All interested persons and affected units of general-purpose government may appear at the hearing and be heard with respect to the petition and proposed ordinance. All interested persons and affected units of general-purpose government may also present oral or written comments on the petition and proposed ordinance.
If a person decides to appeal any decision made by the Board with respect to any matter considered at this meeting, he/she will need a record of the proceedings, and that, for such purpose, he/she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
